Our one simple golden rule
We currently have but one rule to view and use this site: Be good!
"Be good!" defined
"Be good" shall mean what a reasonable person with knowledge of website legal issues considers to be proper behavior for using a website following normal rules of etiquette in polite company in Overland Park, Kansas.
Violations of the "Be good" rule shall include, but are not limited to the following, or attempts at the following:
1. Logging in to this site or others controlled by Raining Colors unless you have been authorized to do so by Raining Colors.
2. Interfering with the performance of this site by any means
3. Altering this site in any way
4. Using this site to send us any commercial solicitations unless we have invited you to do so.
5. Copying or using any copyrighted or trademarked materials from this site without our express authorization including uses that would otherwise be deemed fair use.
Interpretation of "Be good!"
You agree and consent that "Be good!" is not unduly vague under the circumstances and courts of competent jurisdiction may use their own judgment to interpret the meaning of "Be good!" in specific cases.
Jurisdiction and Venue
By using this site, you expressly consent to the jurisdiction of the state and federal courts located in Kansas City, Missouri, USA for the purpose of hearing claims arising out of use of this site or violation of these terms. Similarly, by using this site, you also agree that those same courts are a proper and most convenient venue to hear such disputes, and therefore you agree to waive claims of improper or inconvenient venue to hear such claims.
Violations of the "Be good!" rule
Violations of these terms shall entitle Raining Colors to claims for damages against the violating party or parties in the amount of either its actual damages or liquidated damages of $500 per violation. The prevailing party in such claims shall also be entitled to court costs and reasonable attorney fees.
